Introduction

We are Selfwork GmbH ("Selfwork Platform," "Selfwork," "we," "us," "our.")

We operate the Selfwork Platform Website ("Website") located at https://selfwork.com/, as well as any other related products and services that refer or link to these Terms of Use (the "Terms of Use") (collectively, the "Services").

Selfwork Platform is a freelance portal that connects clients and freelancers for service-based and contract-based collaboration and can help you to hire and review freelancers, manage your freelance portfolio, and support your settlements.

Certain features of the Website may be subject to additional guidelines, terms, or rules, which will be posted on the Website in connection with such features. All such additional terms, guidelines, and rules are incorporated by reference into these Terms of Use.

These Terms of Use constitute а legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Selfwork GmbH., concerning your access to and use of the Services and the Website.

Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms of Use, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Use to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Services after the date such revised Terms of Use are posted.

Eligibility

You can not use the Service and (or) the Website if you:

  • are not able to form legally binding contracts; or
  • are under the age of 18; or
  • a person barred from receiving and rendering services under the laws of Switzerland or other applicable jurisdiction; or
  • are suspended from using the Service and (or) the Website.

We may, at our absolute discretion, refuse to register a person or corporate entity as a User.

We are committed to supporting global access to market opportunities. However, please note that, at this stage, the Service and the Website are available only in a limited number of countries and regions. For details on supported jurisdictions, please refer to: https://legal.selfwork.com. Certain Services may not be accessible in some regions where the Website operates.

Uncovered Countries and Regions

Selfwork Platform services are not available to companies and individuals in the following countries: Afghanistan, Cuba, Iran, North Korea, Somalia, Sudan, South Sudan, India, Zimbabwe.

We also could not provide our Services to companies, freelancers, individuals, and contractors from the OFAC sanctioned list and the FATF black list.

Furthermore, access to our Services is limited exclusively to users whose countries or regions are supported by the Third-Party Payment Service, the payment infrastructure we rely on to process transactions. If your country is not supported by the Third-Party Payment Service, you will not be able to use the Selfwork Platform for payment-related features.

For the most up-to-date list of supported countries, please refer to the official documentation or country availability list of the Third-Party Payment Service which is made available on its official website.

User Registration; Data and Account Management

You can create the following profile types:

  • Freelancer. Freelancers can publish their services on the Website, create a public profile, perform freelance work, and receive payments for their services.
  • Company. Companies can act as a client for freelance services or pay for work under contracts.
  • Contractor. The Contractor can enter into contracts and perform work exclusively for the Companies.
  • Individual. A user without a profile can also act as a freelance service client as a private individual.

You may have multiple Company's profiles, single Freelancer's and (or) Contractor's profile at most.

Account Creation. Compliance Verification Procedures

For you to use some features of the Services and the Website, you have to start an account and provide information about yourself. You warrant that: (a) all required registration information you submit is truthful, up-to-date and accurate; (b) you will maintain the accuracy of such information. You may delete your Account at any time by following the instructions on the Website. Selfwork Platform may suspend or terminate your Account in accordance with these Terms.

To register the Individual profile only the following information is required:

  • First Name;
  • Last Name;
  • Email;
  • Password; and
  • Your consent with these Terms of Use.

There is also a quick registration form that requires only an email address or authorization via Google. Please, note an Email verification is required through a confirmation link sent to the user.

Note regarding Google's API Services: the use of raw or derived user data received from Google Workspace APIs adheres to the Google User Data Policy, including Google's Limited Use requirements.

To create the Contractor's profile, the following information is required:

  • Country & Region;
  • Legal data: First name, Last name, Email, Phone (optional), TIN (Tax Identification Number), Legal Address;
  • Available documents depending on the country and region, which may include: passport, ID card, driving license, or residence permit. Please, select and upload the document from the list.

To create the Company's profile, it may be required to fill:

  • Country & Region;
  • Company's name and legal address;
  • Company's email;
  • Owner's data: Owner Position, Owner Full Name, Register of Directors and Shareholders;
  • Company's data (registered or licensed number) and available documents evidencing the Company was duly registered; the precise list depends on the country and region and may include: Certificate of Incorporation, Memorandum and Articles of Association (M&A) / Articles of Incorporation, Extract from Commercial Register;
  • Tax and other information and papers, the precise list depends on the country and region and may include: Tax Identification Number (TIN), VAT/GST Registration Certificate, Tax Residency Certificate.

To create the Freelancer's profile, you need to provide a wide range of information, but most fields are optional and tailored to your area of expertise.

For you to use payment-related features of the Services and the Website, you must complete the verification process through the Third-Party Payment Service, our designated payment service provider. You warrant that:

  • all required registration information you submit is truthful, up-to-date, and accurate;
  • you will maintain the accuracy of such information.

The Platform does not conduct, control, or receive results from Anti-Money Laundering (AML) and Know Your Customer (KYC) verification procedures that are held by the Third-Party Payment Service. These procedures are performed exclusively by the Third-Party Payment Service in accordance with applicable regulatory requirements. You acknowledge that the Third-Party Payment Service may request additional information or documentation from you directly to complete these verifications.

Your ability to receive payments or initiate transactions on the Platform is subject to successful completion of the Third-Party Payment Service's verification process. You will receive verification status notifications directly from the Third-Party Payment Service, and the Platform will only receive a confirmation of verification status without access to specific verification details.

The Platform may suspend or terminate your Account if the Third-Party Payment Service determines that your Account does not meet its verification requirements.

Compliance Verification Procedures

The Third-Party Payment Service Verification Process. All AML/KYC verification procedures are performed by the Third-Party Payment Service, our designated payment service provider, in accordance with applicable regulatory requirements. The Platform does not conduct, control, or have access to the results of these verification procedures.

User Responsibilities. Users are solely responsible for providing accurate, complete, and up-to-date information to the Third-Party Payment Service during the verification process. Any misrepresentation or failure to provide requested documentation may result in delays or rejection of your verification.

Ongoing Monitoring. The Third-Party Payment Service may perform ongoing AML/KYC monitoring and re-verification of Users as required by law or regulatory obligations. Users agree to cooperate with the Third-Party Payment Service in providing any additional information requested for such purposes.

Verification Status. The Platform will receive only a binary verification status from the Third-Party Payment Service (verified/unverified) and has no access to specific verification details. Users will be notified directly by the Third-Party Payment Service regarding the status of their verification process.

Consequences of Failed Verification. Failure to complete the Third-Party Payment Service's verification process may result in limitations on your ability to process payments or receive funds through the Platform. The Platform reserves the right to restrict access to payment-related features until the Third-Party Payment Service confirms successful verification.

Additional Information, Moderation, and User Responsibilities

Additional information we request

We collect as much information as possible to build a detailed Freelancer's and Contractor's profile and assess their qualifications. Most fields are optional, but providing more information improves the completeness and credibility of the profile. Here is the additional information we request. These data are gathered through a gamified flow via an AI chatbot integrated into the Website:

  • CV/resume uploads;
  • Links to external platforms where services, portfolios, or profiles are published;
  • Attachments (in supported formats):
    • Images: JPG, PNG;
    • Documents: PDF, DOCX;
    • Spreadsheets: XLSX, CSV;
    • Audio: MP3, WAV;
  • Previous freelance experience;
  • Portfolio;
  • Qualification level;
  • Technology matching (skills vs market demand);
  • Basic skills as described in the CV;
  • Service category and subcategory;
  • Years of experience.

Moderation

All User's Content is automatically moderated by AI systems at the time of submission. Additional manual moderation is conducted by the Selfwork Platform moderation support team for dispute resolution, escalation, and content flagged as sensitive or suspicious.

Account Responsibilities

You are responsible for maintaining the confidentiality of your Account login information and are fully responsible for all activities that occur under your Account. You agree to immediately notify the Selfwork Platform of any unauthorized use, or suspected unauthorized use of your Account. Selfwork Platform cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

Access to the Website

Subject to these Terms

Selfwork Platform grants you a non-transferable, non-exclusive, revocable, limited license to access the Website and (or) to use the Services solely for your own personal, noncommercial use.

Certain Restrictions

The rights approved to you in these Terms are subject to the following restrictions:

  • you shall not sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Website;
  • you shall not change, make derivative works of, disassemble, reverse compile or reverse engineer any part of the Website;
  • you shall not access the Website in order to build a similar or competitive Website;
  • you are not allowed to create duplicate Freelancer, Contractor, and Individual profiles and (or) accounts;
  • except as expressly stated herein, no part of the Website may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means unless otherwise indicated, any future release, update, or other addition to functionality of the Website shall be subject to these Terms.

All copyright and other proprietary notices on the Website must be retained on all copies thereof.

Selfwork Platform reserves the right to change, suspend, or cease the Website with or without notice to you. You approved that Selfwork Platform will not be held liable to you or any third-party for any change, interruption, or termination of the Website or any part.

No Support or Maintenance

You agree that Selfwork Platform will have no obligation to provide you with any support in connection with the Website.

Excluding any User Content that you may provide, you are aware that all the intellectual property rights, including copyrights, patents, trademarks, and trade secrets, in the Website and its content are owned by Selfwork Platform or Selfwork Platform's suppliers. Note that these Terms and access to the Website do not give you any rights, title, or interest in or to any intellectual property rights, except for the limited access rights expressed herein Selfwork Platform and its suppliers reserve all rights not granted in these Terms.

Using Selfwork Platform Website

While using the Website you may:

  • use the built-in messenger for all project-related discussions, negotiations, and file exchanges;
  • negotiate price and scope freely (for marketplace (gig-based) transactions);
  • use standardized contract templates provided by Website;
  • use the Website market-based pricing recommendations to help standardize fair pricing;
  • use all the Services, options, and Website's possibilities allowed by these Terms of Use.

While using the Website you will not:

  • post content or items in inappropriate categories or areas on our websites and services;
  • infringe any laws, third party rights or our policies;
  • fail to deliver payment for services delivered to you, unless the Freelancer or the Contractor has materially changed the Freelancer's or the Contractor's Service or a clear typographical error is made;
  • fail to deliver the Freelancer's or the Contractor's Services purchased from you, unless the Company fails to meet the terms, materially alters the terms of the Freelancer's or the Contractor's Services from the listing;
  • circumvent or manipulate our fee structure, the billing process, or fees owed to Selfwork Platform;
  • post false, inaccurate, misleading, defamatory or offensive content (including personal information);
  • take any action that may undermine the feedback or reputation systems;
  • transfer your Selfwork Platform account (including feedback) and Username to another party without our consent;
  • distribute or post spam, unsolicited, or bulk electronic communications, chain letters, or pyramid schemes;
  • distribute viruses or any other technologies that may harm Selfwork Platform, the Website, or the interests or property of Selfwork Platform users;
  • download and aggregate listings from our website for display with listings from other websites without our express written permission;
  • attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by us in connection with the Selfwork Platform Website;
  • copy, modify or distribute rights or content from the Selfwork Platform Website or Selfwork Platform copyrights and trademarks;
  • harvest or otherwise collect information about Users, including email addresses, without their consent;
  • make direct payments between Freelancers or Contractors and the Company outside the Website.

Each User is obliged to:

  • Provide truthful and up-to-date information in their profiles;
  • Clearly describe the scope and outcome of services they offer;
  • Deliver the agreed scope of work within the specified delivery time;
  • Ensure the originality and legality of submitted work;
  • Deliver the full scope of work as outlined in the service parameters;
  • Adhere to the delivery timeline unless otherwise agreed;
  • Provide the number of revisions as agreed or indicated under the task terms;
  • Deliver only original, non-infringing work;
  • Avoid reuse of prior work or use of unauthorized assets;
  • Pass the compliance verification process (as specified herein);
  • Provide complete and accurate briefs or input materials where applicable;
  • Pay for services in advance via the Selfwork Platform controlled payment mechanism;
  • Communicate clearly, respectfully, and professionally with each other;
  • Refrain from demanding work beyond the scope or revision limits;
  • Not attempt to solicit direct/off-platform collaboration or contact.

Services

Services we provide

Selfwork Platform shall provide you with the following types of basic and additional Services:

  • Freelance Marketplace: posting jobs, receiving proposals, hiring talent;
  • Client-Freelancer Chat: built-in messenger with file sharing;
  • Brief & Smart Matching System: auto-suggested talent for tasks based on AI-algorithm;
  • Payment Handling: controlled payments and safe transaction flow;
  • Rating & Review System;
  • Dispute Resolution Module;
  • Task Management Panel: track work, deadlines;
  • Automated Documentation: invoices, contracts, e-signatures;
  • Multilingual Support: EN, AR, etc.;
  • Moderating user content and communication using AI filters and human moderation;
  • Customizable Service Templates for Freelancers;
  • Dispute Mediation & Offering multilingual customer support and structured dispute resolution tools;
  • Basic Legal Framework (standardized contract' templates);
  • Managing Users' onboarding and compliance verification processes.

Prohibited Services for Freelancers and Contractors

All Services offered on the Website are allowed, except for services that involve some form of scam or that are misleading, do not genuinely benefit the customer, cause harm to the website or users, or contradict laws and regulations. Such prohibited services include but are not limited to:

  • Services written in a language other than the official languages of Selfwork Platform;
  • Political or ethnic services, and services violating public laws, countries' regulations;
  • Spam services: services that are unintelligible, mysterious, and mislead customers;
  • Low-quality services;
  • Cryptocurrency trading or promotion Services;
  • Any adult content or explicit materials projects;
  • Services infringing copyrights;
  • Services harming the Website or its users directly or indirectly;
  • Services that lead to dealing and paying outside the Website;
  • One-time services since we cannot guarantee their long-time usability;
  • Services entirely copied from other Users;
  • Remittances such as transferring amounts to a bank account, Western Union transfers;
  • Services that cannot be guaranteed by Selfwork Platform because their execution duration takes more than one month;
  • Services such as forex, pyramid and network marketing, and affiliate marketing;
  • Illicit e-marketing methods that offer to provide fake visitors, reviews, fans, views, and followers;
  • Host reserving services, VPS, VPN-Proxy;
  • Services whose execution requires personal and sensitive information.

Note: We also do not work with Companies and Freelancers from the following industries: Armed Forces Arts and crafts, Chemical Manufacturing, Sales of Chemicals, Farming, Fishery, Food Production, Fundraising, Gambling & Casinos, Leisure Travel & Tourism, Sale of Luxury Goods & Jewelry, Machinery, Maritime, Medical Equipment Manufacturing, Medical Practice, Mining & Metals, Sales of Computer Software, Musicians, NPO's, Pharmaceutical Manufacturing, Philanthropic Fundraising, Photography, Religious Institutions, Sports, Tobacco, Travel Arrangements, Veterinary.

Right to Refuse Service

We may close, suspend, or limit your access to your Account without reason. Without limiting the foregoing, we may close, suspend, or limit your access to your Account:

  • if we determine that you have breached, or are acting in breach of, these Terms of Use;
  • if you underbid on any task in an attempt to renegotiate the actual price privately, avoiding fees;
  • if we determine that you have breached legal liabilities;
  • if we determine that you have engaged, or are engaging, in fraudulent or illegal activities;
  • you do not respond to account verification requests;
  • you do not complete account verification when requested within 3 months of the date of request;
  • you are the subject of a sanctions regime;
  • to manage any risk of loss to us, a User, or any other person;
  • for other similar reasons.

Closing Your Account

You may close your Account at any time. If you want to close your Account please contact our technical support – support@selfwork.com.

Account closure is subject to:

  • not having any outstanding listings on the Website; and
  • resolving any outstanding matters (such as a suspension or restriction on your Account); and
  • paying any outstanding fees owing on the Account.

Fees and Payments

We charge fees for certain services, such as completed tasks, client-side Service, freelancer's subscriptions, and service promotion. Basically, we charge 0%-20% fees, with the option to include additional service upgrades for a higher price.

When you use a Service that has a fee, you have an opportunity to review and accept the fees that you will be charged based on our schedule of Fees and Charges, which we may change from time to time and will update you by placing on our Website. We may add new features for additional fees or change pricing at any time. We will communicate any price changes to you in advance. By accessing or using the Service, you agree to the new pricing.

Unless otherwise stated, all fees are quoted in USD or EUR.

Funds

You may have funds in your Account if you have prepaid for fees or charges or for Services to be provided to you via the Website. If you are the Freelancer or the Contractor, you may have funds if you have successfully completed a task, and funds have been released to you.

Selfwork Platform does not hold or control User funds at any time. All transaction funds are processed and held by the Third-Party Payment Service, a licensed payment service provider, in accordance with the Third-Party Payment Service's regulatory obligations. Selfwork Platform serves solely as a technical interface to connect Users with the Third-Party Payment Service's payment processing services.

You acknowledge and agree that:

  • we are not a bank or other licensed financial institution and do not provide banking services or any financial services to you;
  • we are not acting as a trustee or fiduciary with respect to such funds or payments;
  • we reserve the right to collect any funds owed to us by any other legal means.

The Third-Party Payment Service Integration

All payments shall be processed exclusively through the Third-Party Payment Service as the designated payment service provider. Selfwork Platform utilizes the Third-Party Payment Service as the exclusive payment processing solution for all transactions conducted through the Platform.

Payment Processing and Verification Disclaimer

You acknowledge and agree that payment processing and identity verification (AML/KYC) on the Platform may be conducted by third-party service providers. The Platform does not control and shall not be liable for any issues arising from payment processing, identity verification, or compliance procedures conducted by Third-Party Service Providers.

Tax Obligations

You expressly acknowledge and agree that you are solely responsible for tax compliance and shall be exclusively liable for:

  • calculating, withholding (where applicable), and remitting all taxes imposed by any competent authority;
  • accurate record-keeping, including maintaining complete documentation of all income received and expenses incurred;
  • preparing and filing tax returns, declarations, and financial statements in compliance with applicable laws;
  • timely payment of all tax liabilities arising from transactions conducted via the Selfwork Platform.

Please note that Selfwork Platform does not provide tax, legal, financial, or accounting advice. You agree to indemnify and hold harmless Selfwork Platform from any claims, fines, or liabilities related to your tax non-compliance.

Disclosure to Tax Authorities

You irrevocably consent that Selfwork Platform may disclose to tax authorities, financial regulators, or other government bodies all non-payment transaction records related to your use of the Platform.

User Content

"User Content" means any and all information and content that a user submits to the Website. You are exclusively responsible for your User Content. You bear all risks associated with use of your User Content.

You hereby grant to Selfwork Platform an irreversible, nonexclusive, royalty-free, and fully paid worldwide license to reproduce, distribute, publicly display and perform, prepare derivative works of, incorporate into other works, and otherwise use and exploit your User Content, and to grant sublicenses of the foregoing rights, solely for the purposes of including your User Content in the Website.

Acceptable Use Policy

The following terms constitute our "Acceptable Use Policy": You agree not to use the Website to collect, upload, transmit, display, or distribute any User Content:

  • that violates any third-party right or any intellectual property or proprietary right;
  • that is unlawful, harassing, abusive, tortious, threatening, harmful, invasive of another's privacy, vulgar, defamatory, false, intentionally misleading;
  • that is harmful to minors in any way;
  • that is in violation of any law, regulation, or obligation or restriction imposed by any third party.

Third-Party Links

The Website may contain links to third-party Websites and services. Such Third-Party Links are not under the control of Selfwork Platform, and Selfwork Platform is not responsible for any Third-Party Links.

Other Users

Each Website user is solely responsible for any and all of its own User Content. Because we do not control User Content, you acknowledge and agree that we are not responsible for any User Content, whether provided by you or by others.

Dispute Resolution

Payment Dispute Resolution Services

Selfwork Platform offers the Payment Dispute Resolution Services to Users who have elected to use the payment for the task completed feature. You agree and acknowledge that:

  • Selfwork Platform is not providing legal services;
  • Selfwork Platform will not advise you regarding any legal matters;
  • if you desire to have legal counsel, you will seek independent legal counsel from those licensed to practice law in your jurisdiction.

Other Disputes with Users

You acknowledge and agree that in the event that a dispute arises between you and another User in relation to any task or project, you will first attempt to resolve any differences that you have in relation to such task or project.

Dispute Resolution Policy

The Selfwork Platform Dispute Resolution Policy applies to all the Services offered by Selfwork Platform. For more information, read the Dispute Resolution Policy – https://legal.selfwork.com.

Disputes With Us

If a dispute arises between you and Selfwork Platform, our goal is to address your concerns and, if we are unable to do so to your satisfaction, to provide you with a means of resolving the dispute quickly. We strongly encourage you to first contact us directly to seek a resolution by using our customer support website or emailing us at support@selfwork.com.

Security

You must immediately notify us upon becoming aware of any unauthorized access or any other security breach to the Website, your Account or the Selfwork Platform Services and do everything possible to mitigate the unauthorized access or security breach. You are solely responsible for securing your password.

Disclaimer

The Website is a dynamic, time-sensitive website. As such, information on the Website will change frequently. It is possible that some information could be considered offensive, harmful, inaccurate, or misleading.

Our Services, the Website and all content on it are provided on an 'as is,' 'with all faults,' and 'as available' basis and without warranties of any kind, either express or implied.

To the extent permitted by law, we specifically disclaim any implied warranties of title, merchantability, fitness for a particular purpose, quality, suitability, and non-infringement.

No Insurance or Warranty

We do not offer any form of insurance or other Companies, Contractors or Freelancers protection.

Limitation on Liability

In no event shall we, our related entities, our affiliates or our staff be liable, whether in contract, warranty, tort (including negligence), or any other form of liability, for:

  • any indirect, special, incidental, or consequential damages that may be incurred by you;
  • any loss of income, business, or profits (whether direct or indirect) that may be incurred by you;
  • any claim, damage, or loss that may be incurred by you as a result of any of your transactions involving the Website.

The limitations on our liability to you above shall apply whether or not our related entities, affiliates, or staff or we have been advised of the possibility of such losses or damages arising.

Intellectual Property Rights Infringement

Intellectual Property Rights means any and all intellectual property rights existing worldwide and the subject matter of such rights, including:

  • patents, copyrights, rights in circuit layouts (or similar rights), registered designs, registered and unregistered trademarks, and any right to have confidential information kept confidential;
  • any application or right to apply for registration of any of the rights referred to above.

It is our endeavor to respond to clear notices of alleged intellectual property rights infringement. If you believe that your Intellectual Property Rights have been violated, please notify us via email on our Website and we will investigate.

General

Feedback, Reputation and Reviews

You acknowledge that you transfer copyright of the feedback, reputation, and reviews you leave. You may not use, or deal with, such feedback, reputation, and reviews in any way inconsistent with our policies without our prior written permission.

Indemnity

You will indemnify us (and our officers, directors, agents, subsidiaries, joint venturers, and employees) against any claim or demand, including legal fees and costs, made against us by any third party due to or arising out of your breach of these Terms of Use.

No Class Actions

You and we agree that you and we will only be permitted to bring claims against the other only on an individual basis and not as a plaintiff or class member in any purported class or representative action or proceeding.
